Trademark registration in india can be renewed after 2e426b40

Written by the VenturEasy team | Last updated: 17 October 2026 | Based on the Trade Marks Act, 1999 and the Trade Marks Rules, 2017

Quick answer: Trademark registration in India can be renewed after 10 years. The 10 years are counted from the date of application, and the renewal is filed on Form TM-R on the IP India portal. You can apply up to 1 year before it expires and up to 6 months after expiry (with a surcharge).

Your trademark is not renewed automatically; If you don't apply, your brand name can be removed from the register by the Registry, and you lose the rights that go with registration. Many founders only learn this when they receive a notice or a competitor registers a similar mark.

At VenturEasy, our team of Chartered Accountants, Company Secretaries and Lawyers helps the founders with company registration, compliance and trademark matters. In this guide, we’ll go over everything you need to know about trademark renewal, including when you need to renew, a step-by-step rundown of how trademark renewal works, how much it costs, and what to do if you’ve already missed the date.

How Long Is a Trademark Valid in India?

A registered trademark is valid for 10 years under Section 25 of the Trade Marks Act 1999. However, many owners feel the period starts on the date of the registration certificate. No, it doesn’t. The trademark is valid from the date of application onward.

For example, if you applied on 15 March 2016 and got the certificate in 2018, the validity still ends on 15 March 2026. Always look at the application date on your certificate, not the date it was issued.

Trademark registration in India can be renewed after every 10-year term, and there is no limit on the number of renewals. You can protect a trademark forever as long as the business uses and renews it.

Trademark Registration in India Can Be Renewed After 10 Years: Key Dates to Remember

There are three time windows, and each one has a different cost and risk.

Window

When

What happens

Early renewal

Up to 1 year before expiry

Renewal with the standard government fee only

Grace period

Within 6 months after expiry

Renewal with the standard fee plus a surcharge; the mark stays on the register

Trademark restoration

After 6 months, up to 1 year from expiry

The mark is removed; restoration and renewal are possible at the Registrar's discretion, at a higher cost

Restoration is no longer possible one year from the expiry date. If so, you will usually have to file a new trademark application, and in the meantime, someone else may have registered a similar mark.

Trademark Renewal Fees in India

The Registry charges by class. If your mark is registered in three classes, you should multiply the fee by three. The figures below are the government fees most commonly published as at October 2026. Fees are subject to change. Please check them on the official IP India website before you pay.

Type of filing

E-filing (per class)

Physical filing (per class)

Renewal before expiry

₹9,000

₹10,000

Renewal in grace period (with surcharge)

₹13,500

₹15,000

Restoration and renewal

About ₹18,000

Higher than e-filing

E-filing is less expensive and easier to monitor, making it a better choice for most small businesses.

How to Renew a Trademark Online: Step by Step

The same application, Form TM-R, now covers normal renewal, late renewal with surcharge, and restoration. Older guides will still refer to Forms TM-10, TM-12, and TM-13, but these have been superseded under the 2017 Rules.

  1. Check status and expiry date. On the IP India public search page, search your mark and check that the status says "Registered" and note the actual due date.

  2. First, edit the owner information. Your details must currently match the name, address, and business type on the register. As an example, if your proprietorship has been converted into a company via Private Limited Company Registration, then the change needs to be recorded before you renew. Amendments are filed separately, e.g. on Form TM-P.

  3. Complete Form TM-R. Enter trademark number, class, and owner information. If an agent is filing on your behalf, you will also need a Power of Attorney (Form TM-48).

  4. Log in to the IP India portal and pay the fee. Choose the correct option for filing on time, late, or restoration, make payment online, and keep the acknowledgement. Want an expert to do it? VenturEasy's trademark service includes filing and follow-up.

  5. See the application. The Registry reviews the request and, if all is in order, renews the mark and registers the new validity. Confirm the status until the new date is displayed.

Documents and Details You Need

Renewal is easier than the first registration. Most of the time you will need:

  • Application number and trademark class

  • Name, address and type of business of owner

  • Details of Digital Signature or Authorised Signatory

  • Power of Attorney if an agent or attorney applies for you

  • Any change of name or ownership to be proved

India typically does not require proof of use at renewal. That said, this does not mean that you stop using the mark. A registered mark that is not used for extended periods of time can be challenged on the grounds of non-use.

What If You Miss the Renewal Date?

Make haste. Each month of delay increases the cost and the risk.

  • Within 6 months after expiry: File Form TM-R, the fee, and the surcharge. Your registration continues without interruption, and your rights are protected.

  • After the grace period: The mark may be removed from the register by the Registrar. If it's not on the register, you don't have the protection of a registered mark. If a person files an identical or similar mark in this gap, your request for restoration can be objected to.

  • Within 1 year of expiry: You can apply for restoration and renewal under Section 25(4). You pay the renewal fee, the surcharge, and the restoration fee. The Registrar decides whether to restore the mark, so approval is not guaranteed.

  • After 1 year: No further restoration possible. You have to file a whole new application from the ground up, and you lose the original filing date.

Common Mistakes Owners Make

  • Counting from the wrong day. The 10 years begin from the date of application and not from the date of registration.

  • Waiting for a reminder from the Registry. The owner has the option to renew. Old email IDs and addresses often mean a notice never comes to you.

  • Owner details are out of date. If the register doesn’t match your current business details, this can cause delays to your renewal.

  • Filing during the past week. If you receive portal errors, a payment failure, or a missing signature, you may be placed in the grace period and incur the surcharge.

  • Missing some of the classes. If your mark is registered in more than one class, renew each class. You can remove the class you skip.

Why Timely Renewal Matters

With a registered trademark, you have the exclusive right to use your brand name on your goods or services and to pursue legal action against infringement. You forfeit that statutory protection once the mark is gone. You may still have common law rights from actual use, but it is slower and more expensive. and less certain to prove them.

For a growing business, the brand name is often one of the most valuable assets. Banks, investors, and buyers also want to know if a trademark is valid, and a lapsed mark can complicate fundraising, franchising, or selling the business.

It helps to have a simple habit. Take note of the expiration date in your calendar and set a reminder for at least six months prior. Treat it like any other yearly obligation, like your compliances for a private limited company, and keep one tracking sheet with application number, class, expiry date, and filing status for every mark you own.

Conclusion

Trademark registration in India can be renewed after 10 years. Filing before the expiry date is the safest and cheapest option. If you’ve missed it, the six-month grace period and the one-year restoration window can still save your brand, but both cost more and carry some risk. Check your expiry date today, keep your owner details up to date, and don’t wait till the last minute.
